Every year, since 2014, there has been a rider amendment in the federal spending bill to protect states that have legalized medical marijuana, Forbes notes, and it is only valid when the government is operational. Language that would extend legal protections for state medical marijuana programs from federal interference is included in a new bill expected to pass this week to end the current government shutdown. The bill reads: “None of the funds made available under this Act to the Department of Justice may be used, with respect to any of the States of Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri,...

How the Government Shutdown is Hurting the U.S. Cannabis Industry
(Cannabis, CBD, Food, Growers, Hemp, Kentucky, Legalization, Management, Medical Marijuana, Medical Marijuana Inc, Mexico, Pennsylvania, Production, Products, Regulations, United States, Utah, Washington, Cultivation, Funding) U.S. hemp farmers eager to get to work in 2019 will have to wait: The federal government is currently shut down. While the passage of 2018 Farm Bill and its hemp legalization provision was met with excitement, a now-routine political snafu has halted federal government operations and effectively blockaded the gateway to legal hemp cultivation. Until the federal government reopens for business—until the U.S. Congress approves an appropriations bill—the U.S. Department of Agriculture (USDA) is unable to approve state hemp program regulations and the FBI is unable to conduct required background checks. This presents a problem for prospective hemp farmers.“It could keep someone from getting their business underway,” Jack Wilbur, spokesman for the Utah Dept. of Agriculture and Food, told KUTV on Dec. 31. Under provisions enacted by the 2014 Farm Bill, 40 states now regulate hemp cultivation. Moving forward now, the USDA reserves the authority to approve or reject those states’ (or...

Marijuana Stocks 2018: A Year End Review
(Acquisitions, Alcohol, Australia, Beverages, Biotechnology, Canada, Cannabis, CBD, Deals, Distribution, Events, Florida, Hemp, Investing, Investment, Investments, Investors, Joint Ventures, Legalization, Massachusetts, Media, Medical Marijuana, Michigan, New York, News, Oklahoma, Organic, Production, Products, Recreational, Stock Index, Thailand, Tobacco, United States, Utah, Hedge Fund, Real Estate, Security) Marijuana stocks have been our sole focus since inception and 2018 has been a year full of big industry moves. Likewise, it has also been a big year of “firsts”. We saw the first G7 country to go fully legal when Canada announced one of the biggest events in legal cannabis history. We saw massive cannabis industry deals as well. According to data from Viridian Capital Advisors, a financial and strategic advisory firm for the cannabis industry, Cannabis-related companies raised nearly $13.8 billion so far this year, compared to just $3.5 billion in 2017. The days of wondering if this industry could ever become “mainstream” are over and we’re seeing a serious change in tide. Global governments are beginning to support this marketplace in a major way; something we could have only dreamed of at the beginning of this wild ride when it began just a few years ago. The uptrend in cash flowing into cannabis businesses in the last year has been helped by both legislative changes not only in...

2018 Was a Huge Year for Cannabis
(Banking, California, Canada, Cannabis, CBD, Colorado, Connecticut, Deals, Development, Hemp, Illinois, Investment, Investors, Legalization, Medical Marijuana, Mexico, Michigan, Minnesota, Missouri, New Jersey, New Mexico, New York, News, Oregon, Regulations, United States, Utah, Vermont, Washington) By any measure, cannabis had a banner year in 2018. We had a blast celebrating all of the big wins for cannabis on this blog this past year. Looking back, it was a monumental year for cannabis reform, both in the United States but also internationally. At this point, it feels like there is no realistic scenario in which prohibition carries the day: Federal legalization of marijuana, at least in the United States, feels like a fait accompli. Below are the ten biggest developments in cannabis law and policy over the past twelve months. California commenced its adult use marketplace. California is the fifth largest economy in the world. It was the first U.S. state to pass a medical marijuana ballot initiative, back in 1996, and given the interim developments in states like Colorado, Oregon and Washington, adult-use legalization in the Golden State has been a long time coming. There are still a ton of unknowns about California’s cannabis regulations (it also passed a hemp law ), but the...

How 2018 Is Shaping the Future of American Cannabis Law
(Canada, Cannabis, Cigarettes, Investment, Investments, Investors, Media, Michigan, Missouri, News, Recreational, United States, Utah, Recreational Cannabis) Marijuana has very quickly become the talk of the town throughout the U.S. In the past year alone, we have seen tremendous improvements in the overall sentiment of the substance as well as the hopes for new laws throughout the nation. Various milestones in the past year should help to be able to predict what the future of cannabis can look like if things continue to move in its favor. One of the biggest changes this year occurred as Tilray (NASDAQ: TLRY ) became the first marijuana business to list on a prestigious exchange. Well this may not seem like a huge deal, it represented a major paradigm shift in the way we as a country view cannabis. The company was able to raise over $150 million, with their shares rising substantially. The increase in this share price has helped to illustrate the public desire for cannabis to become as mainstream as possible. As October of this year hit, we saw Canada legalize the use of recreational cannabis throughout the nation. This again created a...

PORTLAND, Ore. — The last year was a 12-month champagne toast for the legal marijuana industry as the global market exploded and cannabis pushed its way further into the financial and cultural mainstream. Canada ushered in broad legalization, and Mexico’s Supreme Court set the stage for that country to follow. U.S. drug regulators approved the first marijuana-based pharmaceutical to treat kids with a form of epilepsy, and billions of investment dollars poured into cannabis companies. Even main street brands like Coca-Cola said they are considering joining the party. “I have been working on this for decades, and this was the year that the movement crested,” said U.S. Rep. 2018 in Cannabis Reform: How Much Did Things Change This Year?
(Advertising, California, Canada, Cannabis, CBD, Colorado, Georgia, Growing, Hemp, Illinois, Legalization, Media, Medical Marijuana, Mexico, Michigan, Missouri, New Jersey, New York, New Zealand, News, Northern Mariana Islands, Oklahoma, Packaging, Regulations, South Africa, South Korea, Tracking, United States, Utah, Vermont, Washington, Cultivation) The year began with a thud. Now-former U.S. Attorney General Jeff Sessions announced on Jan. 4 that his U.S. Department of Justice (DOJ) would repeal the 2013 Cole Memo, a document that had de-prioritized cannabis-related prosecutions and essentially given states a framework with which to legalize and regulate a cannabis market. Uncertainty abounded. “Attorney General Sessions has decided to use the power of the federal government to attack the ability of states to decide their own laws,” said Marijuana Policy Project (MPP) Interim Executive Director Matt Schweich in a statement at the time. “This decision may very well lead to federal agents raiding licensed, regulated, and tax-paying businesses—these businesses are employing thousands of Americans and generating hundreds of millions of dollars in tax revenue for public services including substance abuse treatment programs and new school construction.”That didn’t happen. In fact, the Cole Memo repeal didn’t achieve much of anything...

How 2019 Will be Different for Marijuana
(Canada, Cannabis, Investments, Investors, Legalization, Michigan, Missouri, News, Recreational, United States, Utah, Vermont, Recreational Cannabis) 2018 has been considered to be one of the defining years for the world of cannabis, but as a large amount of instability hit the industry and speculative trading took over, many investors saw marijuana as too risky. As we move through the end of this year and into the next, how will the marijuana market continue to shift and adapt to the future of trading? The past year has seen several states adopt new laws for cannabis use such as Michigan, Vermont, Utah and Missouri. These states are only the most recent to legalize the use of cannabis, but it appears that this has created a domino effect for the U.S. and many areas around the world. Starting with the legalization of recreational cannabis throughout Canada earlier this year, the success of this new market has helped to illustrate just how beneficial a legal marijuana market can be. One executive in the cannabis space, David Goldstein, stated recently that “what I would like to see in 2019 is de-schedulization. From a Schedule One...
