Government Shutdown Stops State Medical Marijuana Protections

Every year, since 2014, there has been a rider amendment in the federal spending bill to protect states that have legalized medical marijuana, Forbes notes, and it is only valid when the government is operational. Language that would extend legal protections for state medical marijuana programs from federal interference is included in a new bill expected to pass this week to end the current government shutdown. The bill reads: “None of the funds made available under this Act to the Department of Justice may be used, with respect to any of the States of Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri,...

The States Most Likely to Legalize Marijuana in 2019
(Arizona, Connecticut, Florida, Growing, Illinois, Kansas, Legalization, Medical Marijuana, Mexico, Minnesota, Mississippi, Nebraska, New Jersey, New Mexico, New York, North Dakota, Ohio, Pennsylvania, Recreational, Rhode Island, South Carolina, South Dakota, Texas, United States, Vermont, Wisconsin, Cultivation) The U.S. now has 33 states that allow medical marijuana and 10 that allow recreational marijuana. Marijuana won big in the 2018 elections, and that trend is expected to continue in 2019. Governors voicing support for marijuana legalization also increased in 2018, Forbes noted. And as legislation passes those governors hopefully won’t drag their feet signing marijuana-related bills into law. “2019 could be a banner year for legalization via state legislatures,” said Mason Tvert from the MPP. “Several states across multiple regions of the country are strongly considering ending prohibition and regulating marijuana for adult use. A growing number of state lawmakers and governors are either getting behind these efforts or coming to the realization that they cannot hold them up much longer. The steady growth of public support we’ve been seeing around the country will likely translate into some major state-level victories for marijuana policy reform.” In 2019, these states are on track to...

Google Searches Reveal Increased Interest in Hemp Following Farm Bill Passage
(Advertising, Alabama, California, Cannabis, CBD, Colorado, Distribution, Growing, Hawaii, Hemp, Hemp Farming, Hemp Products, Indiana, Iowa, Kentucky, Legalization, Maine, Michigan, Mississippi, Montana, Nebraska, North Carolina, Oklahoma, Oregon, Production, Products, South Dakota, Tennessee, United States, Vermont, Washington, Wisconsin, Industrial Hemp, THC, Cultivation) Throughout 2018, hemp legalization has remained a steady backdrop in the Farm Bill debate. U.S. Sen. Mitch McConnell added his Hemp Farming Act into the $867-billion agricultural overhaul back in June; since then, the hemp revolution has been on the tip of farmers’ tongues from Kentucky to California. Along the way, interest in what will happen after passage of the Farm Bill has only grown. When Congress approved the legislation on Dec. 12, the country collectively looked ahead to a time when the hemp-derived CBD market will flourish—to the tune of $22 billion by 2022, according to recent Brightfield Group projections.Wanting to get a sense of how that interest is playing out in the U.S., we turned to Google.Melena Guganus published a report on CBD-related search trends for Remedy Review. She found that Oklahoma, Kentucky and Indiana led the country in digital queries for CBD-related terms. Those traditionally conservative states each have an agricultural legacy; all three developed...

House Committee Advances Medical Cannabis Research Act
(Alcohol, Cannabis, Development, Facilities, Growing, Legalization, Loans, Medical Marijuana, Mississippi, Regulations, Research, United States, Washington, Cultivation, Funding) The House Judiciary Committee approved a bill that would dramatically broaden the country’s access to cannabis for research purposes. A full House floor vote is not yet scheduled, but the committee action is a significant headline in a Republican-controlled legislature. The Medical Cannabis Research Act would open the door to a more robust federal licensing process that would allow medical-grade cannabis to be grown for state-funded research. Since 1968 and up to the present day, only the University of Mississippi has held such a license. The bill, sponsored by U.S. Rep. Matt Gaetz (R-FL), was introduced earlier this year amid an ongoing national debate over how to counteract the opioid addiction crisis. “It is important to promote further research into the curative potential of medical cannabis, so scientists can unlock its full potential,” Gaetz wrote in May. “Medical cannabis can help America fight the opioid epidemic — and more research can show us how.”If the bill were to pass, U...

The Medical Cannabis Research Act Scheduled for Vote on Sept 13
(Cannabis, Mississippi, Research, United States, Dispensaries, Cultivation) A new bill sponsored by U.S. Representative Matt Gaetz and 40 bipartisan co-sponsors called the Medical Cannabis Research Act is scheduled for a Sept 13 vote by the U.S. House panel overseeing federal drug enforcement. If the legislation is passed, the government would have to allow more licensing for marijuana cultivation for research-related purposes. The University of Mississippi has been the only site in the country to cultivate marijuana for research purposes for more than 50 years, Forbes noted. Many researchers and scientists say that the product from this facility is very low-quality compared to marijuana sold at dispensaries. “The federal government should not stand in the way of collaboration that can help people live better lives,” said Geatz. “This will be the first time that a cannabis reform bill will make it through the Judiciary Committee during Republican control of the Congress, ever.” While some amendments to the legislation are expected, Gaetz speculates that they...

Congress Speaks: State Medical Marijuana Laws are Safe Until September 30
(Alabama, Alaska, Arizona, Arkansas, California, Cannabis, Colorado, Compliance, Connecticut, Delaware, Distribution, District of Columbia, Florida, Georgia, Guam, Hawaii, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Medical Marijuana, Mexico, Michigan, Minnesota, Mississippi, Missouri, Montana, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Puerto Rico, Regulations, Rhode Island, South Carolina, Tennessee, Texas, United States, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, Wyoming, Cultivation) Medical cannabis businesses are shielded, for now. State medical marijuana laws and their implementation are safe until September 30th of this year. In a highly anticipated move, Congress extended the protections of the well-known “Rohrabacher-Blumenauer Amendment” (the “Amendment”) last week. This extension is an important political and legal action after Attorney General Jeff Sessions threw the state-legal cannabis industry into a fit from his rescinding of the Obama era Cole Memo in January (he has provided further, largely unhelpful guidance since then). But what impact does the Amendment really have? It could be significant over the coming months, though I am confident that Sessions and other U.S. Attorneys may seek to undermine the spirit of that law as time goes on. The Amendment first passed back in 2014 and has been consistently renewed and extended by Congress in the form of budget riders since then (and this last one is around 2,200 pages ). The Amendment has been construed...

Congress just blocked the Justice Department from using funds to interfere with states’ medical marijuana programs. The Government Only Provides Crappy Marijuana for Research Studies
(Cannabis, Colorado, Medical Marijuana, Mississippi, News, Research, Strains, Testing, United States, Washington, THC, Dispensaries) Marijuana provided to researchers from the government looks nothing like what medical marijuana patients actually purchase – it looks nothing like the marijuana anyone is used to seeing. Due to mandates adopted in the 1960s, marijuana used for research must come from the federal government. Researchers aren’t happy with having to use medical marijuana that looks and feels different from traditional marijuana, according to The Washington Post . Researcher Sue Sisley is currently conducting a study regarding veterans and PTSD. She is less than pleased with the product being supplied for her study. Sisley said, “It doesn’t resemble cannabis. It doesn’t smell like cannabis.” The government-issued marijuana resembles chopped up grass clippings with a yellowish tint. It’s stringy, not chunky with shades of green like it should be.
